Nintendo is facing two new labor complaints filed with the U.S. National Labor Relations Board. These complaints, submitted in December 2025 and January 2026, suggest potential violations of labor laws by Nintendo of America and the third-party company Teksystems. The allegations pertain to prevention of self-organizing activities and unlawful termination or discrimination after filing charges, as reported by Game File.

Specifics about the individual(s) behind these complaints or further details are currently unavailable. According to Game File, Teksystems plays a substantial role in Nintendo's operations, dealing with roles in game-testing and customer service.

In a related incident, MacKenzie Clifton filed a labor complaint against Nintendo in 2022, alleging retaliation for inquiries about unionization. Though Nintendo ultimately settled with Clifton for $25,910, the company maintained the dismissal was due to the disclosure of "confidential information" rather than union-related activities. More about this earlier case can be found here.

These developments occur amid another accusation by the IWGB against Rockstar Games, which is alleged to have dismissed 34 employees in a union-busting effort. Rockstar refuted these claims, asserting the dismissals resulted from the improper sharing of "confidential information." This defense was upheld by The Glasgow Employment Tribunal, which denied a request for interim relief from the affected employees. More details are available at this link.

Meanwhile, Nintendo's financial results reflect robust performance as they experienced substantial growth in hardware and software sales, largely attributed to the successful launch of Switch 2. Within the initial period, the new console sold 10.36 million units, more than double the original Switch figures, leading to a 110% increase in net sales and a 19.5% rise in operating profits, as covered here.
