An author has filed a lawsuit against Bungie, accusing the company of copyright infringement related to the storyline of Destiny 2
Matthew Kelsey Martineau, also known by his pen name Caspar Cole, has taken legal action against Bungie, accusing the company of copyright infringement by allegedly using his material to create the narrative for Destiny 2.
Filed in the U.S. District Court for the Eastern District of Louisiana on October 2, 2024, as highlighted by The Game Post and detailed on Scribd, Martineau claims that components like Destiny’s Red Legion were taken from his works published on WordPress between 2013 and 2014.
The legal document asserts that the Red Legion is pivotal to Destiny 2’s storyline, and even though the game delivers an engaging and captivating experience, it is purportedly based on Martineau's original content.
Martineau's lawsuit elaborates on the alleged resemblances between his writings and the game, asserting that Bungie “deliberately and intentionally” replicated his material without authorization, causing him significant and irreversible harm for which no legal remedy is sufficient.
The legal action seeks to halt the distribution of content that closely resembles Destiny 2. Martineau is also requesting a detailed account of all sales related to infringing products or services.
The lawsuit demands compensation for copyright and intentional infringement and calls for a trial by jury.
