Stellarblade, a film production company, has filed a lawsuit against Sony regarding the title "Stellar Blade"
A lawsuit has been filed by Stellarblade, a film production company based in Louisiana, against video game developer Shift Up and Sony Interactive Entertainment, alleging trademark infringement.
The lawsuit, submitted earlier this month by Stellarblade LLC and its owner Griffith Chambers Mehaffey, was reported by IGN.
Stellarblade, which was set up in 2010, claims ownership of the domain stellarblade.com since 2006 and states that it has been actively using it since 2011.
Shift Up introduced the game Stellar Blade under the name Project Eve in 2019. The game's title was later changed to Stellar Blade in 2022, and in early 2023, it was trademarked as a video game-related property.
In response, Mehaffey registered a trademark for Stellarblade in June 2023 and subsequently sent a cease and desist notice to Shift Up in July.
Mehaffey asserts that the similarity in trademarks causes confusion, as searches for Stellarblade primarily yield results for the game, overshadowing his production company.
He is seeking an indeterminate amount in damages and attorney fees, and has requested that Sony and Shift Up halt the use of the Stellar Blade name or anything similar. Additionally, he demands the surrender and destruction of all materials associated with the name.
Mehaffrey's attorney commented, "We support fair competition, but it's crucial to defend smaller enterprises when larger firms ignore their pre-existing rights."
The lawyer added, "The substantial resources of the defendants have dominated online visibility for Stellarblade, marginalizing Mr. Mehaffey’s well-established business and endangering the enterprise he has maintained for over ten years."
