The authors of Dark and Darker fought off a court injunction to distribute the game
Ironmace can continue to distribute the PvPvE action game Dark and Darker. Studio managing director Choi Ju-hyun told Discord that the court rejected Nexon's request for an injunction against the game.

"The court ruled that 'the Ironmace game does not violate Nexon's copyrights or trade secrets,'" Choi wrote. "The court also found the allegations and evidence provided by Nexon insufficient to close the Dark and Darker server."
Choi noted that Nexon did not show the court its P3 game, the assets and source code of which were allegedly stolen by Choi and used during the development of Dark and Darker.
"However, this is due to limitations in the examination of evidence under the temporary injunction procedure. One of the reasons why the court rejected Nexon's request is the need for careful consideration of evidence during hearings on the main claim," the developer admitted.
Choi has no doubt that if the court really examines everything carefully during the main proceedings, Ironmace's innocence will become obvious.
Nexon has not publicly commented on the incident.
Recall that the proceedings between Nexon and Ironmac last more than two years. The trial started in South Korea, where both companies are registered. In April 2023, Nexon also filed a lawsuit in the United States, but the latter refused to hold a hearing and indicated that Nexon and Ironmace should resolve the dispute at home.
Earlier, Nexon's complaints of copyright infringement led to the removal of the Dark and Darker page on Steam. Dark and Darker is now available on the official website of the game and on the Chaf Games platform.
