The court temporarily banned the removal of TikTok from American stores
A federal judge in the United States has blocked for an indefinite period the decree of President Donald Trump (Donald Trump) banning the download of TikTok. This happened four hours before the decree came into force.
Back in early August, Trump signed an order that banned American companies from making ByteDance transfers starting on September 20. As the presidential administration stated at the time, TikTok poses a threat to the national security of the country — the application collects personal data of US citizens and can transfer them to China.
The owners of TikTok did not agree with the accusations, but they began to look for buyers for the American part of the business. On September 19, it became known that ByteDance had reached an agreement with Oracle and Walmart. Trump approved the deal, but the story is not over.
At the end of last week, the US Department of Commerce allowed Washington to proceed to the implementation of presidential decrees and withdraw TikTok along with WeChat from the US App Store and Google Play. However, yesterday the district court in Washington blocked indefinitely the ban of the Chinese application in the marketplaces.
According to The Wall Street Journal, the court’s decision will give ByteDance more time to get approval from the Chinese authorities to conduct a deal with Oracle and Walmart. Also, the Committee on Foreign Investment in the United States should still consider all the details of the future agreement.
Representatives of TikTok and the Ministry of Commerce have already made comments about the court order.
According to the speaker on behalf of TikTok, the company is pleased that the court agreed with the arguments in favor of TikTok. Now ByteDance intends to continue discussions with the US government and reach a final agreement.
The Ministry of Trade made the decision with less pleasure. It said it would comply with the decision, but would take action in other legal instances.
The validity period of the court ban has not yet been determined. Earlier, November 12 was called the deadline when ByteDance is obliged to sell the American part of the business.
Recall that this is the second decision of a judge from the United States in the last month, which postponed the presidential decrees regarding Chinese applications. Last Sunday, another federal judge banned the authorities from removing the social network WeChat from stores.
